R v Blanchard, 2008 ONCA 761

The trial judge’s refusal to grant an adjournment so that the accused could retain counsel was based on erroneous facts. Accordingly a new trial was ordered. The appeal overturned R v Blanchard, 2007 CanLII 52982, the dismissal of an appeal against the conviction and sentence of two charges of animal cruelty pursuant to s 446 of the Criminal Code.
