Toronto Files Notice to Appeal Shark Fin Ruling

Animal Justice Canada applauds the City of Toronto for giving notice of their intent to appeal the recent decision of the Ontario Superior Court of Justice, which struck down the Shark-fin By-law, prohibiting the possession, sale and consumption of shark fin and shark fin food products within the City.

“The City’s decision to appeal the Shark-fin ruling is of paramount importance. Left unappealed, the decision of Justice Spence may arguably have a substantial narrowing effect on Toronto’s jurisdiction to pass similar by-laws in the future,” said Zeynep Husrevoglu of Animal Justice Canada. “As Canada’s largest municipality, Toronto should embrace the broad authority delegated to them in the City of Toronto Act.”

It is now up to Toronto City Council to decide whether or not to proceed with the appeal. The details of the grounds of appeal are expected to be filed with the Ontario Divisional Court sometime in the near future.
